The notary in Spain: what they do and what they cost
In Spain, the notary is a public official who authenticates documents and gives them legal certainty. You will meet one at many points in your life in the country.
When do you need a notary?
- Buying or selling a home, signing a mortgage.
- Setting up a company.
- Signing a notarised power of attorney (poder), very useful so that someone can sign for you when you are abroad.
- Making a will and accepting an inheritance.
- Getting married, or an uncontested divorce with no minor children.
- Formal statements recording a fact, a document or a situation.
How much does it cost?
Notary fees are set by an official scale. A simple will costs a few dozen euros; a property sale, several hundred depending on the price.
Wills and inheritance for foreigners
If you own assets in Spain, making a will there makes inheritance much simpler. European rules allow you to choose the law of your nationality, for example English law, to apply to your estate.
Documents from abroad
Foreign documents often need an apostille and a sworn translation into Spanish.
